| 本文针对我国农村新出现的土地转包这一经济现象,进行了一定的理论分析与探讨。农村的土地承包,无论采取按人按劳或按人劳比例进行分配,都带有平均分配的色彩,不利于生产力的发展。为适应生产力发展的客观要求,土地转包便应运而生。随着生产力的发展,必然要求土地经营规模逐步扩大,这是各国农业发展带规律性的趋势。但在我国,由于社会生产力特别是农业生产水平低,这一发展趋势不可能是一蹴而就的。本文还分析了土地转包中经济关系的处理问题,着重就有偿转包中土地报酬的经济实质进行了理论探讨,并提出了合理报酬的经济界限。凡在合理界限以内的转包,应予以支持;凡超过合理界限者,应予以严格限制。同时,为保证土地转包的健康发展,还必须有相应的具体措施加以保证。 |

| Preliminary Discussion on Transference of Contracted Responsible Land |

| Abstract: |
| The paper theoretically analysed and probed into the newly-emerged economical phenomenon of transference of contracted responsible land in the rural areas.
That the distribution of contracted responsible land in the rural areas was conducted in accordance with either the population and labourers or the ratio between the population and labourers was unfavourable to the development of productivity,the transference of contracted responsible land came into being. With the development of productivity, it is inevitable to require land operation to be enlarged increasingly. This is a trend with a universal regularity of developing agricultural production of various countries over the world. In China, it is impossible to accomplish this developing trend at one stroke because of low level of social productivity with agricultural production in particular.Accordingly, the paper analysed the problem of how to handle the economical relationship in the contracted responsible land.The paper theoretically probed into economical essence of remuneration in the paid transference of contracted responsible land in particular,and presented economical limitation of reasonal remuneration. Thus,transference of contracted responsible land within economical limitation should be supported and those beyond the limitation must be strictly restricted. Meanwhile,in order to ensure the good development of transference of contracted responsible land, there must be the corresponding concrete measures for gurantee. |
